Mike’s® Hard Lemonade Racing Suit Contest

OFFICIAL RULES

NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.  

This CONTEST is open only to legal residents of the fifty (50) United States OR the District of Columbia who are TWENTY-ONE (21) years of age or older AT TIME OF ENTRY. Void in MD and wherEVER prohibited or restricted by law. 

  1. Eligibility: The Mike’s® Hard Lemonade Racing Suit Contest is open only to legal residents of the fifty (50) United States or the District of Columbia who are twenty-one (21) years of age or older at the time of entry. Void in MD and wherever prohibited or restricted by law. Employees, officers and directors of the following entities and members of their immediate families (defined as parent, child, sibling, spouse) or same households (whether related or not) are NOT eligible to enter the Contest or win the Prize: Mark Anthony Brands Inc. (“Sponsor”), its  parent company, subsidiaries, divisions, affiliates, prize suppliers, advertising and promotion agencies (including Green Street Studios), as well as alcohol beverage licensees (i.e., alcohol beverage suppliers, importers, wholesalers, distributors, and retailers). By participating in the Contest, entrants agree to abide by and be bound by these Official Rules and the judging panel (comprised of representatives of Sponsor and Green Street Studios), which shall be final and binding in all respects.  All federal, state and local laws apply. 
  1. Contest Period: Contest begins at 12:00:01 a.m. Eastern Time (“ET”) on June 30, 2025 and ends at 11:59:59 p.m. ET July 18, 2025.
  1. How to Enter: Internet access and a valid public account on either the Instagram or TikTok social media platforms are required for entry.  An account on either platform may be opened for free if you do not currently have one. For an Instagram account, visit https://www.instagram.com. For a TikTok account, visit https://www.tiktok.com. It is strongly recommended that you carefully review all policies, terms and guidelines of the corresponding social media platform BEFORE creating an account on that platform including the privacy policy addressing the collection, use and sharing of your personal information and your rights relative thereto.  The promotion is in no way sponsored, endorsed or administered by, or associated with Instagram or TikTok.

    To enter the Contest, follow these steps:
  1. You must follow @mikeshardlemonade (if you do not already) to verify you are twenty-one (21) years of age or older.
  2. Tag @mikeshardlemonade.
  3. Post a photo or video showing why you’re the biggest acing fan in the country to your public account on either Instagram or TikTok, along with the hashtags #HardLemonadeandRacing and #MikesHardRacingSuitContest.

    Photo/Video cannot exceed fifteen (15) seconds in length and must comply with the technological requirements of Instagram or TikTok, as applicable. Any material in excess of the fifteen (15) second limit will not be reviewed. Regardless of method, all entries must be received no later than 11:59:59 p.m. ET on July 18, 2025. Receipt of entry may be acknowledged (including via comment posted on @mikeshardlemonade), but such acknowledgment does not constitute any representation of eligibility for the Contest nor is it otherwise binding upon Sponsor. All entries become the sole property of the Sponsor. If entering via mobile device, third party usage fees may apply. You may be charged for wireless Internet access according to the terms of your plan with your cellular or “wi-fi” provider. You are advised to review the pricing plan with the corresponding wireless service provider BEFORE you enter the Contest. Not all wireless providers feature necessary service to participate in the Contest. Check your phone capabilities for specific instructions. Wireless Internet access is not available in all areas. Sponsor assumes no responsibility for lost, late, damaged, stolen, misdirected, illegible, incomplete, inaccessible, incorrect, or garbled entries or other Contest materials, all of which are void.  
  1. Submission Guidelines:

    The posted photo/video will also not result in entry if Sponsor determines in its sole discretion any content in the photo/video (for example, images; audio component of video) [collectively, “content”] is not in compliance with the following Content Restrictions.

    Content Restrictions:
  1. Content must be original and may not include any unauthorized photos, images, comments or plagiarism of any kind.
  2. The content must not be inappropriate, pornographic/sexually explicit, obscene, or otherwise unfit for publication (e.g., comment includes hate speech [including without limitation sexist, misogynist or racist content], profanity, advocate violence, drug use or any illegal act).
  3. The content must be relevant to the Contest theme.
  4. The content must not adversely affect the business reputation or goodwill of Mark Anthony Brands, Inc. or its Mike’s® Hard Lemonade products.
  5. May not be, or ever have been, previously submitted in any contest or promotion.
  6. May not feature, display, refer to, or mention any alcohol companies or brands other than Mike’s® Hard Lemonade.
  7. May not contain any political or politically themed or motivated messages, comments, statements or images.
  8. The content must not show the consumption of alcohol beverages.
  9. The content must not show or imply that the consumption of alcohol beverages is appropriate in conjunction with undertaking any task that requires concentration or physical coordination (e.g., operating a motor vehicle).
  10. The content must not depict persons who are not of legal drinking age.
  11. The content must not include any material that may be of appeal to persons who are not of legal drinking age.
  12. The content must be truthful.

    Subject only to the rights retained by Meta Platforms, Inc. or TikTok Inc. (as applicable), entrant grants to Sponsor and its designees the non-exclusive, irrevocable, perpetual, worldwide, royalty-free, transferable, sublicensable right and license to use, perform, exhibit, reproduce and/or otherwise exploit the content in any manner and in any and all distribution channels, venues or media now known or hereafter devised, without further notice or any compensation to entrant. Entrant (a) waives “Moral Right of Authors” (Droit Moral) in the content pursuant to U.S. law and (b) agrees, upon Sponsor’s request and without compensation, to sign any and all necessary and appropriate documents so as to effect, perfect or record such grant of license rights.

    POSTED PHOTOS/VIDEOS REPRESENT SOLELY THE VIEWS/OPINIONS OF THE APPLICABLE ENTRANTS AND DO NOT REFLECT THE VIEWS/OPINIONS OF SPONSOR OR GREEN STREET STUDIOS IN ANY MANNER. SPONSOR AND GREEN STREET STUDIOS are MERELY REQUESTING PERSONS TO POST PHOTOS/VIDEOS; AND SPONSOR AND GREEN STREET STUDIOS EACH DISCLAIM ANY AND ALL LIABILITY IN CONJUNCTION WITH SAME, INCLUDING BUT NOT LIMITED TO ANY RESPONSIBILITY FOR MODERATING, MONITORING OR APPROVING PHOTOS/VIDEOS POSTED BY ENTRANTS. SPONSOR AND GREEN STREET STUDIOS WILL NOT EDIT OR MODIFY PHOTOS/videOs POSTED FOR THE CONTEST IN CONJUNCTION WITH THE ADMINISTRATION OF THE CONTEST.
  1. Additional Entry Restrictions: Limit one (1) entry per person during the Contest Period; should a person post their photo/video on Instagram and TikTok, they will only receive one (1) entry. Violation of this entry limit will result in only the initial entry being accepted. Automated entries are prohibited and any use of such automated devices will cause disqualification. Re-posting another person’s photo/video will not be counted as an entry (as well as possibly violating such other person’s rights.) But Sponsor reserves the right to void all entries (and disqualify any entrant from the Contest altogether as well as to prohibit such entrant from participating in future promotions offered by Sponsor) if Sponsor determines in its sole discretion that a given person has engaged in egregious, blatant or repeated violations of the entry limit. Proof of submission of entry (that is, posting of photo/video on one’s public account on Instagram or TikTok) does not constitute proof of receipt of same or proof of entry.
  1. Prize: One (1) Grand Prize will be available to be awarded. Grand Prize Winner will receive one (1) custom-made Mike’s® Hard Lemonade branded racing suit. Actual prize may differ from any image of same in Contest advertising (including the Mike’s® Hard Lemonade Racing Suit Contest post) and Sponsor disclaims any liability in conjunction therewith. After verification of the potential Grand Prize winner’s eligibility and compliance with these Official Rules, they will be asked to provide sizing, and a suit will be produced/custom-made according to the sizing provided. Grand Prize winner waives any right of review or approval of the suit after it has been produced and Sponsor will not make alterations or adjustments to the suit after it has been produced. Approximate Retail Value of Grand Prize is $1,500.00.

    Racing suit may not comply with all safety regulations and performance requirements for use by a professional race car driver (by way of example, racing suit may not be flame retardant or flame resistant.)
     

    Alcohol beverages are not part of the Grand Prize. Grand Prize will only be awarded to the verified Grand Prize winner if they have a street address within the 50 United States or the District of Columbia. All costs and expenses associated with the Grand Prize acceptance and use that are not specified herein are the sole responsibility of the Grand Prize winner. Allow approximately 8 weeks for prize fulfillment. If prize is declined by the Grand Prize winner, no alternate prize or compensation will be awarded in conjunction therewith.
  1. Winner’s Determination:

    All eligible photos/videos will be reviewed and judged on or about July 21, 2025. The judging panel (that is, collectively, Sponsor and Green Street Studios) will utilize the following equally weighted criteria in evaluating photos/videos in the judging:

    (a) Creativity
    (b) Originality
    (c) Racing fandom

    The decisions of the judging panel are final and binding in all respects and are not subject to appeal. Entrants acknowledge that the results of the judging are confidential and proprietary information belonging to Sponsor and expressly waive any right to review or inspect such results.

    In the unlikely event of a tie in judging, an additional party will review the tied videos using the above criteria so as to break the tie.
  1. Notification/Verification/Alternates: THE POTENTIAL GRAND PRIZE WINNER WILL BE INITIALLY NOTIFIED VIA DIRECT MESSAGE FROM @mikeshardlemonade ON THE APPLICABLE SOCIAL MEDIA PLATFORM; IT IS THE SOLE RESPONSIBILITY OF ENTRANT TO CONFIGURE THEIR PRIVACY SETTINGS SO AS TO ACCEPT DIRECT MESSAGES FROM @mikeshardlemonade. Sponsor will attempt to notify Potential Grand Prize winner by direct message on or about July 21, 2025 and potential Grand Prize winner will have forty-eight (48) hours to respond to Sponsor’s direct message. Potential Grand Prize winner will be required to complete and sign before a Notary Public an Affidavit of Eligibility, Liability and Publicity Release (where lawful) and complete a W-9 Taxpayer Information form within five (5) business days from the date of their response to Sponsor’s attempted initial notification. If potential Grand Prize winner fails to comply with the preceding requirements, Grand Prize will be forfeited and another potential Grand Prize winner will be selected at Sponsor’s sole discretion according to the selection process outlined above. Alternative Grand Prize winner is subject to all eligibility requirements and must return requested verification materials within five (5) business days of notification.
  1. General Conditions: Entry in the Contest constitutes an entrant’s full and unconditional agreement to abide by and accept the terms and conditions of these Official Rules. No prize substitution except at Sponsor’s sole discretion for Grand Prize of comparable value. Grand Prize is not redeemable/exchangeable for cash. Grand Prize is not transferable except with Sponsor’s prior consent which may be granted or withheld in its sole discretion without liability of any kind. By accepting the Grand Prize, Grand Prize winner waives the right to assert as a cost of winning Grand Prize, any and all costs of redemption or travel to redeem Grand Prize and any and all liability that might arise from redeeming or seeking to redeem Grand Prize. All costs and expenses associated with Grand Prize acceptance and use that are not specified herein are the sole responsibility of the Grand Prize winner.
     

    Taxes on the Grand Prize are Grand Prize winner’s sole responsibility. Grand Prize winner will be issued W-9 IRS Tax Form with the Affidavit of Eligibility, Liability and Publicity Release and a subsequent 1099 IRS Form as the value of the Grand Prize exceeds $599. Upon receipt of the Grand Prize, Grand Prize winner shall be required to comply with any and all applicable federal, state and local law, rules and regulations. 

    Sponsor makes no warranties, and hereby disclaims any and all warranties, express or implied, concerning the Grand Prize furnished in connection with the Contest. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, THE GRAND PRIZE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND SPONSOR HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT. THE ONLY WARRANTIES – IF ANY – ARE THOSE OF THE MANUFACTURER OF THE SUIT.
  1. Releases: By participating, entrant indemnifies, releases and agrees to hold harmless (a) Mark Anthony Brands Inc., its parent company, subsidiaries, divisions, affiliates, prize suppliers, and advertising and promotion agencies (including Green Street Studios) and (b) the directors, officers, agents, representatives, shareholders, employees, successors and assigns of any of the above organizations; and (c) Meta Platforms, Inc. and TikTok Inc. (“Released Entities”) from any and all liability arising from participating in the Contest, any Contest-related activity and/or the acceptance, receipt, possession or use/misuse of the Grand Prize (as applicable). Without limiting the foregoing, Mark Anthony Brands Inc. makes no representation, warranty or guarantee of any kind regarding the Grand Prize. Except where prohibited by law, acceptance of the Grand Prize constitutes the agreement by winner to the use of Grand Prize winner’s name, address (city, state), likeness, voice, photograph or other indicia of persona and/or statements regarding the Sponsor, Mike’s® Hard Lemonade product or the Contest for advertising, publicity and trade purposes by Sponsor and its designees, without further compensation or any notice or approval of any kind.
  1. Limitations of Liability: Sponsor’s computer is the official clock for all purposes of the Contest. Sponsor assumes no responsibility under any legal theory for (a) any incomplete, incorrect or inaccurate information whether caused by web site users, tampering, hacking or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error; (b) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of any web site or entries; (c) any problems or technical malfunctions of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, programming or failure of e-mail on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof, or for injury or damage to entrant’s or to any other person’s mobile device (or any information/materials stored thereon) related to or resulting from downloading materials from any web site or participating in the Contest; (d) entries being inaccessible, irregular or defective in any respect due to filtering by or other operation of the functionality of Instagram or TikTok (as applicable); and (e) late, lost, illegible/garbled, incomplete, damaged, inaccessible, corrupted or jumbled e-mail transmissions or entries regardless of cause (and, all such entries are void.)
  1. Force Majeure: If the Contest is not capable of running as originally planned for any reason beyond the control of Sponsor (e.g., natural disaster, pandemic/epidemic, unauthorized intervention, fraud, civil commotion, the availability of a social media platform due to governmental action), Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest and conduct the Contest and select the Grand Prize winner in a manner which is fair, equitable and in accordance with these Official Rules, if feasible, as determined by Sponsor in its sole discretion. Notice of such action by Sponsor will be posted on @mikeshardlemonade on Instagram and TikTok (assuming it is available).
  1. Tampering: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST OR TO DEFRAUD SPONSOR IN CONJUNCTION WITH THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY SUCH PERSON FROM THE CONTEST (IF APPLICABLE), PROHIBIT SUCH PERSON FROM PARTICIPATING IN FUTURE PROMOTIONS OFFERED BY SPONSOR, AS WELL AS TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
  1. Additional Conditions of Participation: Sponsor is not responsible for any typographical, technical, or other error in the printing of the offer, administration of the Contest or in the announcement of the Grand Prize. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Contest materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, control and govern. If a Contest entry is lost, destroyed or corrupted, the entrant’s sole remedy shall be the opportunity to submit a replacement entry, if feasible; if not feasible (as determined by Sponsor in its sole discretion), Sponsor shall not have any liability of any kind relative to same. Only the type and quantity of prize described in these Official Rules (that is, one [1] Grand Prize) is available to be won in the Contest. Sponsor’s failure to enforce any provision of these Official Rules in a given instance shall not represent the waiver of such provision. Should a court of competent jurisdiction deem a given provision of these Official Rules to be invalid, illegal, or unenforceable, such provision will be replaced with a substitute provision which is valid/legal/enforceable and most closely approximates the original intent of Sponsor. The invalidity, illegality or unenforceability of any provision of these Official Rules shall not affect the validity, legality or enforceability of any other provision of these Official Rules. 
  1. Disputes: This Contest is governed by the laws of the State of Illinois, without respect to conflict of law/choice of law doctrines of Illinois (or of any other jurisdiction which would lead to the application of the law of any jurisdiction other than Illinois). To the fullest extent permitted by law, as a condition of participating in the Contest, entrant agrees (a) that any and all disputes regarding the Contest which cannot be resolved between the parties shall be resolved individually, without resort to any form of class action, exclusively before a federal or state court located in Cook County, Illinois; (b) to the personal jurisdiction of such courts and to waive any right of inconvenient forum, change of venue or any like right; (c) that any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred in entering the Contest (if any), but in no event attorney’s fees, with all other forms of remedy – including but not limited to punitive, incidental, or consequential damages and injunctive relief – being expressly waived.
  1. Winner’s List: For the winner’s list, please send a self-addressed stamped envelope to “Mike’s Hard Lemonade Racing Suit Contest”, 167 N. Green Street, 6th Floor, Chicago, IL 60607. All requests must be received by August 18, 2025. Winner’s list will be available after September 1, 2025.
