THIS CONTEST IS INTENDED FOR PARTICIPATION IN THE FIFTY (50) UNITED STATES AND DISTRICT OF COLUMBIA ONLY AND WILL BE GOVERNED BY U.S. LAW. DO NOT ENTER IF YOU ARE NOT LOCATED IN THE UNITED STATES. Further eligibility restrictions are contained in the Official Rules below. Grand Prize Trip is scheduled for June 3, 2022, through June 6, 2022, to stay at the Mike’s® Hard Freeze House in Los Angeles, CA. WINNER MUST BE AVAILABLE TO TRAVEL BETWEEN JUNE 3, 2022, AND JUNE 6, 2022, OR WILL BE INELIGIBLE TO RECEIVE THE GRAND PRIZE.

  1. DESCRIPTION: The “Mike's® Hard Freeze House Contest” (the “Contest”) offers eligible entrants (each, an “Entrant” and collectively, “Entrants”) the opportunity to complete an online entry form and respond to the question “What's your favorite trend from the 90s?” in 50 words or less (the “Response” and collectively with the entry form, the “Submission”) for consideration as described below. The sponsor of this Contest is Mark Anthony Brands Inc., Chicago, IL 60661 (“Sponsor”). The administrator of this Contest is Creative Zing Promotion Group, 2100 E. Robinson St., Orlando, FL 32803 ("Administrator"). The Sponsor and Administrator shall collectively be referred to as the “Contest Entities”. The Contest is void where restricted or prohibited by law.
    The Contest will operate as follows:
    • Submission Period: The Submission Period begins on Wednesday, May 11, 2022, and ends at 11:59:59 pm Pacific Time (“PT”) on Wednesday, May 18, 2022 (the “Submission Period”).
    • Random Selection: On or about Thursday, May 19, 2022, up to fifty (50) Submissions will be selected at random to progress to Submission Review, Evaluation & Judging.
    • Submission Review, Evaluation & Judging: The up to fifty (50) randomly selected eligible Submissions will be reviewed and evaluated by the “Judges” (as that term is defined below) according to the criteria in Section 6 of these Official Rules.
    • Grand Prize Winner Notification: Potential Grand Prize winner (the "Winner") will be notified on or about Friday, May 20, 2022, according to Section 7 of these Official Rules.
  2. ELIGIBILITY: In order for an Entrant to participate in the Contest and to be considered as the potential Winner, the Entrant must meet the following eligibility criteria:

    • Entrant must be a legal United States resident and physically reside within the fifty (50) United States or the District of Columbia.
    • Entrant must be at least twenty-one (21) years of age at the time of submission.
    • Entrant must not be under any contractual obligation that would conflict with this Contest or the Official Rules, including but not limited to obligations under professional guild obligations, talent agent or talent management agreements, or music recording agreements.
    • Entrant must be the rightful owner (or have authorized use) of the e-mail address associated with the Submission. In the event of a dispute over the identity of an Entrant or potential winner in the Contest, the Entrant or potential winner will be deemed the authorized account holder of the e-mail address associated with the entry. “Authorized Account Holder” is defined as the natural person in whose name the e-mail account was opened. In the event a dispute regarding the identity of an Entrant or potential winner cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible.
    • Entrant must NOT be an employee, owner, shareholder, officer or director of Contest Entities, or their respective parent companies, affiliates, divisions, subsidiaries, agents, representatives, promotion and advertising agencies, and alcohol beverage licensees (i.e., alcohol beverage suppliers, importers, wholesalers, distributors and retailers), together with the immediate family members and/or those living in the same household of such persons (collectively, “Household Members”). For purposes of the Contest "Household Members" shall mean those people who share the same residence at least three months a year; "Immediate Family Members" shall mean parents, stepparents, legal guardians, children, stepchildren, siblings, step-siblings, or spouses.
    • Entrant, if selected as the Winner, must consent to a background check as a condition of being considered or confirmed as the Winner, and will be required to provide his/her Social Security Number for the purpose of submitting to a background check (which may include a review of criminal records) to be confirmed as the Grand Prize Winner. Such background check may include (but is not limited to) investigation of criminal or other arrest or conviction record, review of Social Media profiles, and any other factor deemed relevant by Contest Entities to help ensure that an individual’s participation in the Contest will not, in Contest Entities’ sole discretion, bring the Released Parties (as defined below) into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Released Parties, as determined by Sponsor in its sole and absolute discretion. If requested, Entrant agrees to sign a waiver authorizing the release of personal and background information. Contest Entities reserve the right to contact any person or entity, including any third party, referenced in the background check; If Contest Entities conduct a background investigation on a potential Winner and determine in their sole discretion that awarding a prize to such potential Winner, publicizing any facts or details about the potential Winner or an association of the potential Winner with Contest Entities or the Contest might reflect negatively on Contest Entities and/or their products or services or the Contest, then Contest Entities will have the right in their sole discretion to disqualify the potential Winner and select an alternate potential Winner (in which event the terms described above will apply to such alternate), time permitting. And, if potential Winner is disqualified based on the results of the background check, he/she will not receive any compensation of any kind nor shall Contest Entities have any liability to him/her under any legal theory.

    Entries may not be acknowledged except as provided herein. Contest Grand Prize is non-transferable and cannot be substituted, sold or bartered.
  3. HOW TO ENTER: During the Submission Period, eligible Entrants must visit the Contest website located at https://www.mikeshardfreezehouse.com (the “Website”), and follow the on-screen instructions to provide a written response of 50 words or less to the question "What's your favorite trend from the 90's?".

    Responses must:
    • Be in English and no more than fifty (50) words.
    • Be Entrant’s own original, previously unpublished work; the Entrant must be the rightful owner of the Response and have the rights, title, and interest necessary to utilize the Response in compliance with these Official Rules.
    • Be in accordance with the restrictions listed below.
    • Be included only in the designated text box portion of the entry form and cannot be submitted otherwise (e.g., as a file attachment).

    Responses must NOT:
    • Contain subject matter which is, or could be considered, in the sole discretion of Contest Entities, obscene, pornographic, violent, defamatory, libelous, discriminatory, illegal, offensive, threatening, profane, hateful, degrading, harassing, or otherwise unlawful or objectionable.
    • Contain material that infringes or violates any applicable laws or regulations or any right of a third party including (1) patent, trade secret or other proprietary or contractual rights; (2) right of privacy or publicity; or (3) any confidentiality obligation.
    • Contain any derogatory references to the Contest Entities, or any of their parent companies or any of their products or services.
    • Contain any reference to the consumption of alcohol beverages including that consumption of alcohol beverages is appropriate when operating a motor vehicle or other activities requiring a high degree of alertness and concentration.
    • Contain any reference to persons who are under 21 years of age.
    • Be the work product of more than one (1) person: only the Entrant may be the author of the Response.

    Once submitted, Responses cannot be modified or supplemented by Entrant.

    Upon completion of the Response, each Entrant will be required to complete the online entry form by providing all of the information requested, including but not limited to the Entrant's full name, zip code, date of birth, and e-mail address. Additionally, Entrants will be invited to opt-in to receive promotional emails from the Sponsor, subject to Sponsor's Privacy Policy. Please note: agreeing to receive future email updates from Sponsor is optional and will have no bearing on the outcome of the Contest. After completing the Response and entry form, Entrant must confirm that they have read, understand and agree to the Official Rules and click “Submit” to submit their one (1) Submission into the Contest.

    All Submissions must be received by 11:59:59 pm PT on Wednesday, May 18, 2022. Limit one (1) Submission per person for the duration of the Contest. Submissions in excess of the limit may result in disqualification of the Entrant. Contest Entities will determine in their sole discretion which Submissions have satisfied the eligibility requirements. Participation in the Contest constitutes Entrant's understanding of, full and unconditional agreement to, and acceptance of these Official Rules. Sponsor reserves the right to disqualify any Entrant that Sponsor determines to be in violation of any term contained in these Official Rules. Sponsor's/Administrator’s decision not to enforce a specific provision of these Official Rules in a given instance does not constitute a waiver of that provision or of the Official Rules generally. ELIGIBLE ENTRANTS MUST SUBMIT THEIR ENTRY IN ACCORDANCE WITH THESE OFFICIAL RULES.

    IMPORTANT: Entrant’s Submission may appear on the Website or in the Sponsor’s social media stream. (But, such posting of Entrant’s Submission does NOT constitute any representation that the Submission is eligible or that it has been selected as the potential winner nor is it otherwise binding upon Contest Entities.) If Entrant does not want his or her Submission possibly to be made public, he or she should not enter the Contest. (For clarity, nothing herein in any way obligates Sponsor to make a given Entrant’s Submission public.) Any attempt by an Entrant to obtain more than the stated number of entries by using multiple/different identities, registrations, logins, and/or any other methods will void such Entrant's Submission and that Entrant may be disqualified from the Contest. Incomplete, unreadable, or unintelligible entries will be disqualified. All information provided by Entrants becomes the property of Sponsor. Sponsor has the right to change the Submission Period, and all other dates or deadlines in connection with the Contest, at any time and in its sole discretion, and will post corresponding updates on the Website.

  4. RANDOM SELECTION: On or about Thursday, May 19, 2022, up to fifty (50) Submissions will be selected at random to progress to Submission Review, Evaluation & Judging. The fifty (50) randomly drawn Entrants WILL NOT receive notice of their status. Sponsor reserves the right to proceed to Submission Review, Evaluation & Judging with fewer than fifty (50) Submission should there be fewer than fifty (50) eligible Submissions received. If applicable, odds of Submission being selected for Submission Review depend on the number of eligible Submissions received.
  5. SUBMISSION REVIEW, EVALUATION & JUDGING: Immediately following the Random Selection, selected Submissions will be reviewed and evaluated by representatives of Contest Entities and other parties (the “Judges”). Eligible Submissions will be judged in accordance with the following weighted criteria (“Judging Criteria”) to select one (1) winner based on the criteria and weighting below:
    • True "90's-ness" of the Response: 40%
      • True "90's-ness" of the Response: 40%
    • Originality of the Response: 30%
    • Entertainment Value of Response: 30%

    In the event of a tie, such tied Responses will be reevaluated in accordance with the criteria above and the Response with the higher/highest point score on “Originality of the Response” will be deemed the potential Winner. Sponsor reserves the right to extend the Submission Period and all other dates associated with the Contest in the event an insufficient number of eligible Submissions are received, as determined by the Contest Entities, in their sole discretion. If no eligible Submissions are received, the prize will not be awarded. All decisions of the Judges are final on all aspects of the Contest. Judging scores will not be revealed; and, by making a Submission, Entrant acknowledges that the judging scores are confidential information which is proprietary to Contest Entities, and he/she waives any right to review judging scores under any legal theory.

  6. WINNER NOTIFICATION: On or about Friday, May 20, 2022, one (1) potential Winner, as determined by the judging results, will be notified via the email provided in the Submission. Potential Winner will be required to respond as directed by the Administrator to the notification within twenty-four (24) hours (or a shorter time if required by exigencies) of first attempted notification. The failure to respond timely to the notification may result in forfeiture of potential Winner status and, in such case, Contest Entities may select an alternate Winner, based on the judging results, time permitting. The Released Parties shall have no liability for any notification that is lost, intercepted, or not received by a potential Winner for any reason. Potential Winner will be required to execute and return an affidavit of eligibility, a liability release, and, unless prohibited by law, a publicity release; confidentiality releases, on-camera releases and/or production releases; and any other documents as may be required by Contest Entities in their sole discretion (collectively, the "Prize Claim Documents") within twenty-four (24) hours (or a shorter time if required by exigencies, as determined by the Contest Entities in their sole discretion). Failure to respond to the notification or return the Prize Claim Documents within the specified time period may result in forfeiture of the Grand Prize and selection of an alternate potential Winner from the remaining eligible entries (based on the judging results), time permitting. The prize will not be awarded/fulfilled until all such properly executed documents are returned. If the potential Winner is found to be ineligible, or if they have not complied with these Official Rules or decline advancing as the Winner for any reason, potential Winner will be disqualified, and in such case, Contest Entities may select an alternate Winner, time permitting. Administrator, in its sole discretion, will attempt to contact up to three (3) potential winners of the Grand Prize in accordance with the above procedure, after which the Grand Prize may go unawarded if it remains unclaimed. Administrator reserves the right to disqualify anyone not fully complying with the Official Rules. Winner must provide the Administrator with a valid social security number for tax reporting purposes before the Grand Prize will be awarded. An IRS Form 1099 will be issued to the Winner for the actual value of the Prize received for the year in which the Prize was fulfilled. ALL FEDERAL, STATE AND LOCAL TAXES, AND ANY OTHER COSTS AND EXPENSES, ASSOCIATED WITH THE RECEIPT OR USE OF THE GRAND PRIZE (NOT SPECIFIED HEREIN) ARE THE SOLE RESPONSIBILITY OF THE WINNER. Sponsor reserves the right, in their sole discretion, to provide a projected tax gross-up allowance to help offset income tax liability; however, Sponsor is in no way obligated to provide such gross-up. Should Sponsor choose to do so, Sponsor makes no representation or warranty that the gross-up allowance will completely offset the winner’s income tax liability. If applicable, the projected tax gross-up allowance will be awarded via check in an amount determined by the Sponsor for the year in which the Prize is fulfilled. If income taxes exceed such amount, the additional income tax liability shall be the sole responsibility of the Winner, as applicable. Potential Winner is bound to confidentiality and is NOT permitted to publicly announce their status as the Winner (in any way, including social or traditional media). A Winner’s breach of such confidentiality will result in his/her forfeiture of Winner status, and, in such case, Contest Entities may select an alternate based on the aforementioned judging results, time permitting.
  7. GRAND PRIZE:There is one (1) Grand Prize available consisting of one (1) 4-day / 3-night trip for the Winner and up to three (3) guests (each a "Guest" and collectively the "Guests") to stay at the Mike’s® Hard Freeze House (the “House”) in Los Angeles, CA (the “Trip”). Mike’s® Hard Freeze House consists of three bedrooms with standard amenities, 1990s décor. Includes access to swimming pool.

    Each Guest must be twenty-one (21) years of age or older as of the departure date for the Trip. The Trip includes: (a.) round trip economy class air transportation for Winner and Guests from a major commercial airport near Winner's home to an airport in the greater Los Angeles area (as determined by Contest Entities in their sole discretion)*; (b.) sedan car service to and from Winner’s home and selected major commercial airport near Winner's home (Winner’s home correlating to the zip code provided at time of entry), and sedan car service between the House and the airport in the greater Los Angeles, CA area for Winner and Guests; (c.) accommodations for three (3) consecutive nights for the Winner and Guests at the Mike’s® Hard Freeze House** (four (4) bedrooms, one (1) bedroom for Winner and one (1) bedroom for each Guest, up to three (3) Guests); (d.) one (1) Chef experience/catered meal at the House (times and menu to be selected by Sponsor in its sole discretion); and (e.) ten thousand dollars ($10,000) cash. Approximate Retail Value (“ARV”) of Trip: Fourteen Thousand Five Hundred Fifty Dollars ($14,550).

    * If Winner lives within 150 miles of Los Angeles (as determined by Contest Entities in their sole discretion), air transportation may be substituted with another method of transportation by Sponsor in their sole discretion, with no further obligation to the Winner.

    **Winner and Guests are solely responsible for providing a list of any food allergies, dietary restrictions or special food needs. Commercially reasonable efforts will be made to accommodate such requests, but Winner and Guests understand that Contest Entities/Chef may not be able to do so. In the event any request cannot be accommodated, Winner or applicable Guest will be responsible for securing their own meals in place of the Chef experience/catered meal.

    If Winner accepts Grand Prize with fewer than the full complement of three (3) Guests, the Grand Prize will be awarded in increments appropriate for the actual number of travelers (including the Winner him/herself) and Contest Entities shall not have any further obligation to the Winner.

    ALCOHOL IS NOT PART OF THE PRIZE.

    Actual Prize value will depend on point of departure, any airfare fluctuations and seasonal pricing and may be substantially higher or lower than the stated ARV. All Prize details are at the sole discretion of the Contest Entities. Ground transportation and airline for Trip will be selected by Contest Entities in their sole discretion. Airline carrier’s regulations and conditions apply. Once Trip dates have been booked, no changes, extensions or substitutions are permitted, except at Sponsor’s sole discretion. Sponsor will not replace any lost or stolen tickets or travel vouchers. Sponsor reserves the right to structure travel routes in its sole discretion. Winner cannot assign or transfer the prize to another person. No cash alternative is allowed, except at the sole discretion of Sponsor. If the Grand Prize cannot be awarded (in whole or in part) due to circumstances beyond the control of Sponsor, a substitute prize/prize element of equal or greater retail value may be awarded. If the Winner is unable or unwilling to accept the prize, or any portion thereof, as stated, the prize may be forfeited in its entirety at the sole discretion of Sponsor. The value of the prize represents the Sponsor’s good faith determination of the maximum retail value thereof. No refunds or credits for changes are allowed. The ARV of prize is subject to price fluctuations in the consumer marketplace based on, among other things, any gap in time between the date the ARV is estimated for purposes of these Official Rules and the date the prize is awarded or redeemed. All other expenses and costs, not expressly listed above, including, but not limited to parking, meals (except as expressly provided herein), laundry service, local and long distances telephone calls, souvenirs, transportation, taxes, tips/gratuities/service charges, entertainment, and all other charges and items not otherwise described above are Winner’s sole responsibility. Other restrictions may apply. Winner and Guests agree that they undertake the Trip at their own risk. Winner will not receive cash or any other form of compensation if actual costs are less than the Prize ARV in these Official Rules.

    TRAVEL IS SCHEDULED FOR JUNE 3, 2022 - JUNE 6, 2022. WINNER MUST BE AVAILABLE TO TRAVEL ON THESE DATES OR WILL BE INELIGIBLE TO RECEIVE THE GRAND PRIZE. The dates of departure and return are subject to change at Sponsor’s sole discretion. All Grand Prize details are at the sole discretion of the Sponsor. If any of the Grand Prize elements, or any portion thereof, listed in the Grand Prize description does not or cannot take place as scheduled or at all, for reasons included but not limited to scheduling conflicts, cancellations, postponement, or for any other reason, then assuming the Winner is willing and able to travel on the dates chosen by Sponsor, the Winner will receive the remaining components of the Grand Prize which shall constitute full satisfaction of Sponsor’s Grand Prize obligation to the Winner, and no other or additional compensation will be awarded.

    The Winner’s Guests must be at least twenty-one (21) years of age. Guest will be required to sign and return a travel companion eligibility/liability release and, unless prohibited by law, a publicity and media release. Once travel commences, no unscheduled stopovers are permitted; if an unscheduled stopover occurs, full airfare may be charged to the Winner from stopover point for the remaining segments, including return, of the Trip. Contest Entities are not liable for any expenses incurred as a consequence of flight cancellation/delay. Trip may not be combined with any other offer and travel may not qualify for frequent flyer miles or other perks. Contest Entities will not obtain travel insurance on behalf of the Winner or Guests. Travel is subject to flight availability and other travel restrictions may apply. Winner is responsible for all applicable travel and other insurance, all applicable airport charges, including, without limitation, any baggage charges, airport taxes, fuel charges and any applicable Customs or Federal inspection fees. The round-trip air transportation element for prize begins and ends at the point of departure. Winner and all Guests must travel together on travel itinerary as prescribed by Contest Entities. ALL FEDERAL, STATE AND LOCAL TAXES, AND ANY OTHER (UNSPECIFIED) COSTS AND EXPENSES, ASSOCIATED WITH THE RECEIPT OR USE OF THE GRAND PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER. The Grand Prize, and all portions of the Grand Prize, are awarded WITHOUT WARRANTY OF ANY KIND, express or implied, without limitation. Any Grand Prize depictions are for illustrative purposes only.

    By accepting the Grand Prize, the Winner, on Winner's behalf, and the Guests, expressly assume the risk that they may be exposed to COVID-19, the Coronavirus that causes COVID-19, or other communicable and/or infectious diseases. Winner and Guests expressly understand that these risks include contracting COVID-19 or other communicable and/or infectious diseases and the associated dangers, medical complications and physical and mental injuries, both foreseen and unforeseen, that may result from contracting COVID-19 or other communicable and/or infectious diseases. In addition, the Winner and Guests must abide by all applicable COVID regulations and local ordinances and Trip-specific rules, including but not limited to social distancing, masks, testing, and proof of vaccination requirements.

    Acceptance of Trip shall constitute and signify Winner and all Guests agreement and consent that Sponsor and their respective designees may use Production materials including but not limited to the Winner and Guests names, city, state, likeness, and Winner's Submission for promotional, advertising or other purposes, worldwide, in perpetuity, in any and all media now known or hereafter devised, including the Internet, in any manner, without limitation and without further payment, notification, permission or other consideration, except where prohibited by law. Winner and Guests will not be compensated for participation in any television appearance, if applicable. If it is ever determined that the Production in which Winner or any Guest appears falls within the jurisdiction of any union or guild agreement ("Guild Agreement"), then: (a) Winner and any applicable Guest agree to accept the minimum scale payments payable pursuant to such Guild Agreement (if any, it being agreed that none will be payable if any coverage waiver applies); (b) Sponsor will have the option to secure unlimited and extended editing rights on the Internet and in new media by paying $100 to the applicable participant(s); and (c) upon Sponsor request, Winner and any applicable Guest will execute any standard union/guild performer agreement.

    Trip Conduct: Winner and Guests shall conduct themselves with due regard to the public conventions and morals. The Winner and Guests shall not, while representing the Contest Entities during the Trip and/or any of the events, or any portion thereof, listed in the Grand Prize description, commit an offense involving moral turpitude under local laws or ordinances. The Winner and Guests shall not commit any act that will tend to degrade the Contest Entities in society or bring the Contest Entities into public hatred, public disrepute, contempt, scorn, or ridicule, or that will tend to shock, insult or offend the community or public morals or decency or prejudice the Contest Entities. In the event Winner and/or Guest(s) engage in behavior that (as determined by Contest Entities in their sole discretion) is obnoxious or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, the Contest Entities reserve the right to expel the Winner and Guest(s) from any of the events, or any portion thereof, listed in the Grand Prize description, terminate the Trip early and send the Winner and Guest(s) home with no further obligation related to the Grand Prize (and, if the conduct in question is deemed sufficiently egregious by the Contest Entities, they expressly reserve the right to pursue other available legal remedies).

  8. GRANT OF RIGHTS: Each Entrant or Winner hereby irrevocably grants to the Sponsor and its designees, affiliates, successors and assigns, the non-exclusive, irrevocable, fully paid, universal license to use, copy, sublicense, transmit, distribute, publicly perform, publish, delete or display the Submission and/or Production (and all elements embodied therein, together or separate from Entrant’s and/or Winner’s name, city and state of residence, statements, and/or image or likeness), in any media now known or hereafter devised including, but not limited to all forms of electronic media, print media and all forms of internet and wireless protocol in perpetuity and throughout the universe for advertising, marketing, publicity and promotional purposes in connection with the Contest or other marketing, unless prohibited by law. Sponsor shall have the right, in their sole discretion, to edit, composite, morph, scan, duplicate, or alter the Submission and/or Production for any purpose which Sponsor deems necessary or desirable, and each Entrant or Winner irrevocably waives any and all so-called moral rights they may have therein.
  9. NATURE OF RELATIONSHIP/WAIVER OF EQUITABLE RELIEF: Each Entrant and Winner, understands and acknowledges that the Released Parties (as defined below) have wide access to ideas, designs, and other materials, and that new ideas are being developed by their own employees, suppliers, and/or business partners. Each Entrant and Winner also acknowledges that many ideas may be competitive with, similar or identical to an idea and/or each other in theme, idea, format or other respects and agrees that they will not bring any action against Released Parties or any third parties, and will not be entitled to any compensation, as a result of Released Parties or any third party’s use of any such material similar or identical to a Submission. Each Entrant and Winner acknowledges and agrees that the Released Parties do not now and shall not have in the future any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of copyright, patent, trade secret, or other intellectual property rights in and to an idea, Submission and/or the Production. Nothing stated herein should be construed to create any kind of employment relationship, contractor relationship, partnership or joint venture with Contest Entities. Each Entrant and Winner further agrees that Released Parties have no duty of confidentiality or other fiduciary duty as to their Submission.
  10. RIGHTS OF CONTEST ENTITIES: Contest Entities shall have the right and sole discretion to disqualify any Entrant or Winner who they find to be in violation of the provisions hereof, who does not fully comply with all of Contest Entities’ requirements in connection with any and all legal clearance issues, or that they find, in their sole discretion, to be otherwise objectionable for any reason. The Released Parties are not responsible for any materials provided by any Entrant or Winner which are deemed harmful or offensive to others or for any harm incurred as a result of participation in the Contest. All statements and opinions made by any Entrant or Winner are those of such Entrant or Winner only, and the Released Parties neither endorse nor shall be held responsible for the reliability or accuracy of same. Released Parties are not responsible for the content or practices of third-party websites that may be linked to the Contest Website. The Contest Website may also be linked to websites not operated by companies affiliated with Contest Entities. Visitors to those sites should refer to each site’s separate privacy policies and practices.
  11. CONDITIONS OF PARTICIPATION/RELEASES: Sponsor, in its sole discretion, may designate the Administrator to handle winner selection and notification tasks on Sponsor’s behalf. Sponsor, in its sole discretion, may designate a travel agency to handle Prize fulfillment on Sponsor’s behalf. All federal, state and local laws and regulations apply. By participating, each Entrant agrees to be bound by these Official Rules and the decisions of the Contest Entities, which shall be final in all respects. Each Entrant and Winner hereby releases the Contest Entities, and each of their respective parent companies, subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies and prize suppliers and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the "Released Parties") from any and all actions, claims, injuries, death, losses or damages arising in any manner, directly or indirectly, from participation in this Contest and/or acceptance, receipt, possession or use/misuse of the prize. The Released Parties shall not be liable for: (i) any injuries, losses, liabilities or damages of any kind including personal injury or death caused by the Grand Prize or resulting from acceptance, possession or use of the Grand Prize including participation in any activity or travel related thereto, or from participation in the Contest; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) late, lost, delayed, stolen, misdirected, inaccessible, incomplete, unreadable, inaccurate, garbled or unintelligible entries, communications or affidavits, regardless of the method of transmission; (v) any inability of winner to accept or use the prize (or portion thereof) for any reason and such Prize or portion thereof shall be forfeited; or (vi) any printing, typographical, human administrative or technological errors in any materials or activities associated with the Contest which are beyond the reasonable control of any of the Released Parties. Contest Entities disclaim any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Contest. Contest Entities reserve the right, in their sole discretion, to cancel, modify or suspend the Contest (or any portion of the Contest) at any time for any reason or should a virus, bug, computer problem, unauthorized intervention, extenuating circumstance or other problem/cause corrupt or inhibit the administration, security or proper play of the Contest and, in such situation, will select the Winner in the manner set forth above from eligible non-suspect Submissions received prior to and/or after such action or in such manner as deemed fair and appropriate by the Contest Entities. Contest Entities may prohibit Entrant from participating in the Contest or winning the Grand Prize if, in its sole discretion, it determines Entrant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or any other unfair practices or intending to annoy, abuse, threaten or harass any other Entrants or Contest Entities’ representatives. ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE CONTEST. SHOULD SUCH AN ATTEMPT BE MADE, CONTEST ENTITIES RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. BY ENTERING THE CONTEST, ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE CONTEST, OR ANY AWARD AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED, (IF ANY), NOT TO EXCEED TWO HUNDRED FIFTY DOLLARS ($250.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; AND 3) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS, AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.
  12. INDEMNITY: Each Entrant and Winner shall indemnify, defend and hold harmless the Released Parties from and against any and all claims, damages, actions, liability, loss, injury or expense, including reasonable attorneys’ fees and costs, arising out of or in connection with: (a) participation in the Contest; (b) a breach or allegation which if true would constitute a breach of any of the representations, warranties or obligations herein; and (c) acceptance, possession, grant, or use of the prize, including without limitation, personal injury, death and property damage arising therefrom.
  13. DISPUTES: This Contest is governed by the laws of the United States and the State of Illinois, without respect to conflict of law doctrines. As a condition of participating in this Contest, participants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Illinois having jurisdiction. Further, in any such dispute, under no circumstances will participants be permitted to obtain awards for, and hereby waive all rights to claim punitive, incidental or consequential damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (e.g. costs associated with entering), and participant further waives all rights to have damages multiplied or increased.
  14. PRIVACY POLICY: Any personal information supplied by you to Sponsor will be subject to its privacy policy posted at https://www.mikeshard.com/privacy/. By entering the Contest, Entrant grants Sponsor permission to collect, use and share Entrant’s email address and any other personally identifiable information with the other Contest Entities for the purpose of Contest administration and Prize fulfillment (the latter if applicable).
  15. WINNER’S LIST/OFFICIAL RULES: To obtain the winner’s name or a copy of these Official Rules, send a request along with a stamped, self-addressed envelope to “Mike’s® Hard Freeze House" Winner or Rules, 2100 E. Robinson St., Orlando, FL 32803. Residents of Vermont may omit return postage on Rules requests Requests must be received no later than June 30, 2022.
