- This is a national Sweepstakes put on by Mike's Hard Lemonade Co. ("Sponsor"). Sweepstakes is offered throughout the 50 states of the U.S. and Washington, DC, except for California and Utah. Sweepstakes is void in California and Utah. Void in Puerto Rico. No purchase is necessary to enter this Sweepstakes. A purchase will not increase your chances of winning. There are two ways to enter:
- ENTRY CODE METHOD OF ENTRY: To enter, print your name, address, telephone number, date of birth, product entry code from under a bottle cap, and the words "mike’s HARD PUNCH™ ROCKS Sweepstakes” on a 3" x 5" card and mail it to: “mike’s HARD PUNCH™ ROCKS Sweepstakes”, P.O. Box 6612, Saddle Brook, NJ 07663, to be postmarked by 12/31/10 and received by 1/7/11. Or, between 12:00:01 AM Eastern Time (“ET”) on January 1, 2010 and 11:59:59 PM ET on December 31, 2010, go to www.mikeshard.com and enter the code found under the cap of your Mike's Hard Lemonade Co. HARD PUNCH™ product by following the on-screen instructions. You will be required to submit a Mike's Hard Lemonade Co. product entry code from under the bottle cap of specially marked packaging if entering via this entry method. During the promotion period, entry codes are available, while supplies last, under the bottle caps of specially marked bottles of Mike's Hard Lemonade Co. HARD PUNCH™ products. Entry codes are also available without purchase by online request at website. (Limit one request per person, per email address, per day). In order to participate using this method, you will need internet access and a valid email address. Limit one entry per person, per email address, per day. If more than one online entry is received from one person per email address per day, only the first online entry submitted will be considered valid. In the event of a dispute regarding the identity of the person submitting an electronic entry, the entry will be deemed to be submitted by the "authorized account holder," the person in whose name the email account is registered, provided that person meets all eligibility criteria set forth in these Official Rules. Any attempt to defraud or misrepresent age, name, or address by an entrant may be prosecuted to the fullest extent permitted by law. Sponsor’s computer shall serve as the official clock for the on-line component of the Sweepstakes. Sponsor and its agencies assume no responsibility for errors due to computer malfunctions, software errors, transmission problems, network availability, programming error or interruptions in operations, lost or misdirected email, all of which are void. Sponsor and its agencies not responsible for any damage to any participant's or third party’s computer system/software (or information/data stored thereon) related to or resulting from participation or downloading any materials in this promotion. Sponsor and its agencies assume no responsibility for undeliverable emails resulting from any form of active or passive email filtering by a user's internet service provider and/or email client or for insufficient space in user's email account to receive email. Proof of submitting entries/requests will not be proof of receipt by Sponsor. It is the sole responsibility of the entrant to notify the Sponsor in writing if the entrant changes his/her email address prior to the selection of winners in the applicable drawing. Online entrants are subject to all online notices including, but not limited to, Sponsor's Privacy Policies. All entries become the property of the Sponsor and will not be returned.
- NO PURCHASE NECESSARY/NO-CODE MAIL-IN METHOD OF ENTRY: Complete the official sweepstakes form (available where Mike’s Hard Lemonade Co. HARD PUNCH™ products are sold for off-premise consumption) or print your name, address (no P.O. Boxes), daytime and evening telephone numbers, date of birth and the words "mike’s HARD PUNCH™ ROCKS Sweepstakes" on a 3" x 5" card and mail to: mike’s HARD PUNCH™ ROCKS Sweepstakes, P.O. Box 6612, Saddle Brook, NJ 07663. You may mail as many entries as you wish, but limit one entry per outer mailing envelope. Promotion begins January 1, 2010 and ends on December 31, 2010. All mail in entries must be postmarked by January 3, 2011 and received by January 10, 2011. Facsimiles or mechanical reproductions of entries will not be accepted. Any attempt to defraud or misrepresent age, name, or address by an entrant may be prosecuted to the fullest extent permitted by law. Sponsor and its agencies assume no responsibility for lost, late, damaged, misdirected, illegible, incomplete, incorrect or postage-due mail entries, all of which are void. Proof of submitting entries will not be proof of receipt by Sponsor. It is the sole responsibility of the entrant to notify the sponsor in writing if the entrant changes his/her address or phone number prior to the selection of winners in the applicable drawing. All entries become the property of the Sponsor and will not be returned.
- RANDOM DRAWINGS:
- Weekly Drawings: There will be (52) weekly drawings (each, a “Weekly Drawing,” and collectively the “Weekly Drawings”), with one drawing for each week of the Promotion Period. Each Weekly Drawing will each have (1) Weekly First Prize Winner and (100) Weekly Second Prize Winners; see Rule 3 (e). Except for the last week of the Promotion Period, each week of the Sweepstakes begins at 12:00:01 AM ET on Friday and ends at 11:59:59 PM ET on the immediately following Thursday; the last week ends at 11:59:59 PM ET on Friday, 12/31/2010. Each Weekly Drawing will consist of all eligible entries received during that week. Entries not selected in a Weekly Drawing will be retained for subsequent Weekly Drawings. Limit one (1) Weekly Drawing prize per person, household, or email address during the Promotion Period. Weekly drawings will be conducted on or about 7 days after weekly entry period ends except for the last Weekly Drawing which will be conducted on or about 1/14/2011.
- Final Drawing: All eligible entries received during the Promotion Period will be entered into a random drawing held on/about 1/21/2011 (the “Final Drawing”) to select the winners of: One (1) grand prize, five (5) first prizes, five (5) second prizes; and (50) third prizes (prizes are described in detail in Rule 3). Limit one (1) Final Drawing prize per person, household or email address. Entries of winners of the Weekly Drawings will be included in the Final Drawing.
- Drawing Conditions: The Weekly Drawings and Final Drawings will be conducted by Alcone Marketing Group, the Administrator. Odds of winning a Weekly Drawing prize depend on number of eligible entries received for a given Weekly Drawing; odds of winning a Final Drawing prize depend on the number of eligible entries received for the Final Drawing. All winners, except for Third Prize and Weekly Second Prize Winners, will be notified by express courier and/or email and will be required to sign and return an Affidavit or Declaration of Eligibility, a Liability Release and, except where prohibited by law, a Publicity Release within 10 days of notification or the prize will be forfeited and may be awarded to another randomly selected winner (the alternate winner to be selected from among all remaining eligible entries received for the applicable drawing). In addition, for the Final Drawing Grand Prize, each guest of the Grand Prize winner must sign and return a Liability Release and, except where prohibited by law, a Publicity Release, prior to issuance of travel documents (assuming that winner does not select cash option, as described in Rule 3 below). If a winner cannot be contacted for any reason or does not respond within 10 days, the prize will automatically be forfeited and an alternate winner will be randomly selected. Third Prize and Weekly Second Prize winners will receive their prize by regular mail or email (Weekly Second Prize winners only). A return of any prize as undeliverable will cause such prize to be forfeited an alternate winner randomly selected.
- PRIZES: Prizes are not redeemable for cash, unless specified herein otherwise, and are non-transferable. Sponsor reserves the right to substitute a prize of equal or greater value. All federal, state, and local taxes on the prizes are winner's sole responsibility. Winners who receive prize(s) valued at $600 or more will be required to furnish his/her Social Security Number for the sole purpose of preparation of any tax forms as required by law and will receive a 1099 Misc. Form reporting the fair market value of the prize(s). By accepting prize(s), winner waives the right to assert as a cost of winning said prize(s) any and all costs of redemption or travel to redeem said prize(s) and any and all liability that might arise from redeeming or seeking said prize(s). Winner also accepts sole responsibility for all costs in conjunction with acceptance/use of prize(s) not specified in these Rules. Limit one prize per household. Except where prohibited, acceptance of any prize constitutes winner's consent to use his/her name, likeness and biographical data for advertising, trade and promotional purposes without additional compensation. In no event will more prizes be awarded than stated in these Official Rules. YOU MUST SAVE YOUR ENTRY CODE FOR PRIZE VERIFICATION, IF REQUESTED BY SPONSOR (IF PARTICIPATING VIA ENTRY CODE METHOD OF ENTRY).
FINAL DRAWING PRIZES:
- GRAND PRIZE: One Grand Prize winner will receive either (i) A trip for four to his or her choice of ONE of the following destinations (London, New York, or Los Angeles), for five days and four nights (final itinerary to be determined by Sponsor), or (ii) $12,000 in cash (made payable in the form of a check to winner). Trip includes round-trip coach air transportation for winner and up to three guests (guests must be age 21 or older and cannot be an employee/officer/director of an alcohol beverage licensee); standard hotel accommodations for four nights (one room - double occupancy); ground transportation to and from destination airport and hotel and a check for $4,000 which may be used for meals and incidentals (included in total approximate retail value of prize). Approximate retail value (ARV) of Grand Prize Trip Package is $18,000. Actual value may depend on point of departure and time of travel, as well as other factors. (The difference between the ARV and Actual value of the prize will not be awarded.) If destination option is selected, trip must be taken by 1/21/2012. All reservations and travel arrangements must be made through travel agent selected by Sponsor and are subject to availability. If the Grand Prize winner lives within approximately 150 miles of their travel destination (as determined by Sponsor in its sole discretion), ground transportation will be provided in lieu of air transportation. If Grand Prize winner has less than three travel guests accompany him/her on trip, Grand Prize will be awarded in amounts appropriate for actual number of travelers and winner will not receive any compensation in conjunction therewith. Winner must confirm travel dates at least 60 days prior to intended date of departure. Winner and guests must travel together on the same itinerary. The trip may not be combined with any other offer and travel may not qualify for frequent flyer miles. Airline tickets are non-refundable, non-transferable, and are not valid for upgrades. Blackout dates and other restrictions apply. Winner and guests are solely responsible for obtaining a valid U.S. passport and/or any other required travel documents. Sponsor is not responsible for lost or mutilated travel documents or tickets and none will be replaced. Prize is non-transferable. Grand Prize winner must notify Sponsor of choice between (i) or (ii) within 10 days of verification of winner’s eligibility and compliance with these Official Rules.
- FIRST PRIZE: Five first prizes of a Gibson® USA Les Paul Studio guitar, having an approximate retail value of $1,900.00 each; or a prize of equivalent value will be awarded.
- SECOND PRIZE: Five second prizes of Rock Music Gift Pack courtesy of Warner Custom Products, A Warner Music Group Company having an approximate retail value of $250 each; or a prize of equivalent value will be awarded. Approximate retail value does NOT represent resale value of Rock Music Gift Pack.
- THIRD PRIZE: Fifty third prizes of mike’s HARD PUNCH™ ROCKS T-shirts, having an approximate retail value of $15.00 each; or a prize of equivalent value will be awarded.
- WEEKLY PRIZES:
- WEEKLY FIRST PRIZE: 500 song downloads, having an approximate retail value of $495. One winner per week, 52 in total.
- WEEKLY SECOND PRIZE: 3 song downloads, having an approximate retail value of $2.97, 100 winners per week, 5,200 in total. Total Approximate Retail Value of all Prizes is $ $70,684.
- GENERAL RULES: Entrants must be 21 years old or older at the time of entry. Open to legal residents of the U.S.A. excluding residents of California or Utah. Sweepstakes is void in California, Utah and where prohibited. Void in Puerto Rico. Employees, officers or directors of the following entities and members of their families or households are not eligible for participation under any circumstances: Mike's Hard Lemonade Co., Warner Music Group, Gibson Guitar Corporation, and their respective affiliates, printers, advertising and promotion agencies, alcoholic beverage licensees (including alcohol beverage suppliers, wholesalers, distributors, or retailers). All federal, state, and local laws apply. Winners agree to release and hold harmless Mike's Hard Lemonade Co., Alcone Marketing Group, Warner Music Group, Gibson Guitar Corporation, and their respective employees, officers, directors, agents, representatives, parent companies, affiliates, suppliers, distributors, advertisers, promotional, and judging agencies from any and all liabilities, claims, or actions of any kind whatsoever for injuries, damages or losses to persons or property which may be sustained in connection with participation in the Sweepstakes or receipt, ownership or use of any prize. Winners agree that Mike’s Hard Lemonade Co. and its agencies are in no matter responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the Sweepstakes and/or the awarding of any prize.
- SPONSOR'S RIGHTS: Sponsor reserves the right, in its sole discretion, to cancel, abbreviate, or suspend this Sweepstakes should it be compromised by computer virus, program bugs, non-authorized human intervention or other causes beyond the control of the Sponsor, including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state of local government law, order or regulation, order of any court or jurisdiction. In such event, Sponsor shall conduct the Sweepstakes and award the prizes in a manner determined by Sponsor in its sole discretion to be fair, appropriate and consistent with these Official Rules. Sponsor shall post notice of such action on its website, www.mikeshard.com. Sponsor is not responsible for any typographical, technical, or other error in the printing of the offer, administration of the promotion or in the announcement of prizes. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any sweepstakes materials and the terms and conditions of the official rules, the official rules shall prevail, govern and control.
- DISPUTES: This Sweepstakes is governed by the laws of the United States and the State of Washington, without respect to conflict of law doctrines. As a condition of participating in the Sweepstakes, participant agrees (to the fullest extent that he/she may do so under applicable law) that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Washington having jurisdiction. Participant expressly agrees that the courts of Washington State have personal jurisdiction over him/her and waives any right of change of venue. Further, the entrant agrees that, by entering the Sweepstakes (i) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prizes awarded, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred (if any), including costs associated with entering the Sweepstakes, but in no event attorney's fees; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental, or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.

- WINNERS NAMES: Winners names (first name, last initial) may be posted on the Mike’s Hard Lemonade web site. To be notified of the winners of major prizes, please send a self-addressed, stamped envelope to “mike’s HARD PUNCH™ ROCKS Sweepstakes” Winners, P.O. Box 6613, Saddle Brook, NJ 07663. All requests for the major prize winners’ names must be received by February 1, 2011.
