Mexican Riviera Adventure Sweepstakes

OFFICIAL RULES

This is a Sweepstakes put on by Mike's Hard Lemonade Co. ("Sponsor"). Sweepstakes is offered throughout the 50 states of the U.S. and Washington, D.C., except for California and Utah. Void in Puerto Rico. No purchase is necessary to enter this Sweepstakes. A purchase will not increase your chances of winning. There are two ways to enter:
1. ONLINE METHOD OF ENTRY:Between 12:00:01 AM (ET) on March 1, 2010 and 11:59:59 PM (ET) on September 9, 2010, go to www.mikeshard.com and enter by following the on-screen instructions. In order to participate online, you will need internet access. Limit one entry per person, per email address, per day. If more than one online entry is received from one person per email address per day, only the first online entry submitted will be considered valid. In the event of a dispute regarding the identity of the person submitting an electronic entry, the entry will be deemed to be submitted by the "authorized account holder," the person in whose name the email account used to enter the Sweepstakes is registered, provided that person meets all eligibility criteria set forth in these Official Rules. Any attempt to defraud or misrepresent the age, name, or address by an entrant may be prosecuted to the fullest extent permitted by law. Sponsor's computer shall serve as the official clock for the online component of the Sweepstakes. Sponsor assumes no responsibility for errors due to computer malfunctions, software errors, transmission problems or interruptions in operations, lost or misdirected email, all of which are void. Sponsor not responsible for any damage to any participant's or third party's computer system/software related to or resulting from participation or downloading any materials in this promotion. Sponsor assumes no responsibility for undeliverable emails resulting from any form of active or passive email filtering by a user's internet service provider and/or email client or for insufficient space in user's email account to receive email. Proof of submitting entries will not be proof of receipt by Sponsor. It is the sole responsibility of the entrant to notify the sponsor in writing if the entrant changes his/her email address prior to the selection of the winner in the drawing. Online entrants are subject to all online notices including, but not limited to, Sponsor's Privacy Policies. All entries become the property of the Sponsor and will not be returned.
2. MAIL-IN METHOD OF ENTRY: Complete the official sweepstakes form (available where THE CLASSIC MARGARITA by mike's™ product is sold) or print your name, address (no P.O. Boxes), daytime and evening telephone numbers, date of birth and the words "THE CLASSIC MARGARITA by mike's™ Mexican Riviera Adventure Sweepstakes" on a 3" x 5" card and mail to "THE CLASSIC MARGARITA by mike's Mexican Riviera Adventure Sweepstakes"Entries, P.O. Box 6623, Saddle Brook, NJ 07663. You may mail as many entries as you wish, but limit one entry per outer mailing envelope. Program begins March 1, 2010 and ends September 9, 2010. All mail-in entries must be postmarked by September 9, 2010 and received by September 16, 2010. Facsimiles or mechanical reproductions of entries will not be accepted. Any attempt to defraud or misrepresent the age, name, or address by an entrant may be prosecuted to the fullest extent permitted by law. Sponsor assumes no responsibility for lost, late, damaged, misdirected, illegible, incomplete, incorrect or postage-due mail entries, all of which are void. Proof of submitting entries will not be proof of receipt by Sponsor. It is the sole responsibility of the entrant to notify the sponsor in writing if the entrant changes his/her address or phone number prior to the selection of winner. All entries become the property of the Sponsor and will not be returned.

2. RANDOM DRAWING: Prize winner will be determined in a random drawing from all eligible entries received. The drawing will be conducted by an independent organization ("Administrator") whose decisions will be final and binding in all matters relating to this sweepstakes. The drawing will take place on or about October 4, 2010. The winner will be notified by mail and phone on or about October 11, 2010 and will be required to sign an affidavit of eligibility and liability release, and (except where prohibited by law) a publicity release, within 10 days of notification or the prize will be forfeited and may be awarded to another randomly selected entrant. In addition, each guest of the winner must sign and return a liability release and, except where prohibited by law, a publicity release, prior to issuance of travel documents. If winner cannot be located or does not respond within 10 days, the prize will automatically be forfeited and an alternate winner will be randomly selected. Odds of winning will be determined by the total number of eligible entries received. No purchase necessary. A purchase will not increase your chances of winning.

3. PRIZE: One Grand Prize winner will receive his/her choice of either (i) a trip for four to a resort in Playa del Carmen, Mexico for five days and four nights (final itinerary to be determined by Sponsor), OR (ii) $8,000 USD in cash (made payable in the form of a check to winner). Trip includes round-trip coach air travel for winner and up to (3) guests (guests must be age 21 or older and cannot be an employee/officer/director of an alcohol beverage licensee); hotel accommodations (double occupancy); $2000 USD in cash which may be used by winner for meals (excluding alcohol beverages) and transportation. Approximate retail value (ARV) of Grand Prize Package is $11,000 USD. If trip prize option is selected, actual value may depend on point of departure and time of travel, but in no event will Sponsor be required to spend more than a total of $11,000 USD on all Grand Prize elements. (The difference between the ARV and Actual value of the prize will not be awarded.) Important Notice: Trip must be taken by October 15, 2011. All reservations and travel arrangements must be made through travel agent selected by Sponsor and are subject to availability. Winner must confirm travel dates at least 45 days prior to departure. Winner and guests must travel together on the same itinerary. The trip may not be combined with any other offer and travel may not qualify for frequent flyer miles. Airline tickets are non-refundable, non-transferable, and are not valid for upgrades. Blackout dates and other restrictions apply. Winner and guests are solely responsible for obtaining a valid U.S. passport and any other required travel documents. If winner has fewer than (3) guests accompany him/her on trip, prize will be awarded in amounts appropriate for actual number of travelers and winner will not receive any compensation in conjunction therewith. Sponsor is not responsible for lost or mutilated travel documents or tickets and none will be replaced. Prize is non-transferable. All federal, state and local taxes on the prize are winner's sole responsibility. By accepting the prize, winner waives the right to assert as a cost of winning said prize, any and all costs of redemption or travel to redeem said prize and any and all liability that might arise from redeeming or seeking said prize. Winner is responsible for all gratuities, meals, ground transportation not specified (for trip prize, if applicable) and any other incidental costs and expenses not identified in these Official Rules. Winner will be required to furnish his/her Social Security Number for the sole purpose of preparation of any tax forms as required by law. Winner will receive a 1099 Misc. Form reporting the actual value of the prize. Except where prohibited, acceptance of prize constitutes winner's consent to use of his/her name, likeness and biographical data for advertising, trade and promotional purposes without additional compensation. In no event will more than one prize be awarded, as stated in these Official Rules. Sponsor reserves the right to substitute the trip prize option described above at Sponsor's discretion for a prize of equal or greater value.

4. VERIFICATION: Prize claim subject to verification by Administrator/Sponsor. You are not the winner until your prize claim has been timely received and verified/validated by the Administrator/Sponsor, and you have complied with these Official Rules.

5. GENERAL RULES: Entrants must be 21 years old or older at the time of entry. Open to legal residents of the U.S.A. excluding residents of CA, UT and Puerto Rico, and where prohibited. Employees, officers or directors of the following entities and members of their families or households are not eligible for participation under any circumstances: Mike's Hard Lemonade Co. and its respective affiliates, printers, advertising and promotion agencies, alcohol beverage licensees (including alcohol beverage suppliers, wholesalers, distributors, or retailers). All federal, state, and local laws apply. Winner agrees to release Mike's Hard Lemonade Co. and its respective employees, officers, directors, agents, representatives, parent companies, affiliates, suppliers, distributors, advertisers, promotional, and judging agencies from any and all liabilities, claims, or actions of any kind whatsoever for injuries, damages or losses to persons or property which may be sustained in connection with receipt, ownership or use of the prize. Winner agrees that these entities are in no matter responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the Sweepstakes and/or the awarding of the prize. Notwithstanding the foregoing, in the event that the preceding release is determined by a court of competent jurisdiction to be invalid or void for any reason, the entrant agrees that, by entering the Sweepstakes (i) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prizes awarded, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorney's fees; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental, or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.

6. SPONSOR'S RIGHTS: Sponsor reserves the right, in its sole discretion, to cancel, abbreviate, or suspend this Sweepstakes due to mistakes, errors, or omissions by Sponsor, or should it be compromised by computer virus, program bugs, non-authorized human intervention or other causes beyond the control of the Sponsor, including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state of local government law, order or regulation of any court or jurisdiction, without any compensation or liability to any entrant. In such event, Sponsor shall conduct the Sweepstakes and award the prize in a manner determined by Sponsor in its sole discretion to be fair, appropriate and consistent with these Official Rules. Sponsor shall post notice of such action on its website, www.mikeshard.com. Sponsor not responsible for any typographical, technical, or other error in the printing of the offer, administration of the promotion or in the announcement of the prize. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any sweepstakes materials and the terms and conditions of the official rules, the official rules shall prevail, govern and control.

7. DISPUTES: This Sweepstakes is governed by the laws of the United States and the State of Washington, without respect to conflict of law doctrines. As a condition of participating in the Sweepstakes, participant agrees (to the fullest extent that he/she may do so under applicable law) that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Washington having jurisdiction. Participant expressly agrees that the courts of Washington State have personal jurisdiction over him/her and waives any right of change of venue. Further, the entrant agrees that, by entering the Sweepstakes (i) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or the prize, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred (if any), including costs associated with entering the Sweepstakes, but in no event attorney's fees; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental, or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.

9. CONFIDENTIALITY: By entering, you understand that you may be contacted by the Sponsor or its advertisers with future promotional offers. Information provided by you to participate in this Sweepstakes is subject to Sponsor's privacy policies located at http://mikeshardlemonade.com.

10. WINNER'S NAME: Winner's name (first name, last initial) will be posted on web site. To be notified of the name of the winner, please send a self-addressed, stamped envelope to "THE CLASSIC MARGARITA by mike's™ Mexican Riviera Adventure Sweepstakes" Winner, P.O. Box 6624, Saddle Brook, NJ 07663. All requests for the winner's name must be received by November 4, 2010.
